Terms and Conditions of Sale

These Terms and Conditions (“Terms”) govern all sales by SEN Creations (“we”, “us”, or “our”) to the customer (“you” or “your”), whether as a consumer or business. By placing an order, you agree to these Terms.

2. Definitions
Consumer: An individual purchasing outside of business purposes.
Business Customer: A person or entity buying for use in business.
Customised Products: Goods made to your individual specification or personalised.
3. Orders and Contract Formation
3.1. All orders are subject to acceptance and availability.
3.2. A contract is formed when:
We confirm your order in writing (e.g., via email); or
You place an order through our website; or
We receive a valid purchase order from you; or
You provide signed acceptance of a formal quote.
3.3. We reserve the right to refuse or cancel orders at our discretion.
4. Pricing and Payment
4.1. All prices are in GBP (£). We are not VAT registered, so VAT is not charged.
4.2. Accepted payment methods:
Card (debit/credit)
BACS (bank transfer)
Cash (by arrangement only)
Invoice (for approved customers)
4.3. Payment is due:
Immediately at point of sale for consumers unless invoice terms are agreed.
Within 30 days of the invoice date for approved business or consumer invoicing arrangements.
4.4. For customised or large-scale orders, we may require a non-refundable deposit (typically 30–50%) before commencing work. Work will not begin until the deposit is received.
5. Late Payment Terms (All Customers)
5.1. If you fail to pay by the due date (as per clause 4.3), we reserve the right to:
Charge interest on the overdue amount at a rate of 4% per annum above the Bank of England base rate, accruing daily (for consumers).
For business customers, apply statutory interest at 8% above the Bank of England base rate, under the Late Payment of Commercial Debts (Interest) Act 1998, plus a fixed compensation fee of £40–£100 depending on the invoice amount.
Suspend or cancel future orders.
Instruct debt recovery services; you will be liable for all associated recovery costs.
5.2. We reserve the right to reduce or waive late payment charges at our discretion.
5.3. These late payment terms also apply retrospectively to all unpaid invoices issued prior to the effective date of these Terms. Any such outstanding balances may be subject to the interest, charges, and recovery actions outlined above.
6. Delivery
6.1. Delivery is made to the address provided during checkout or stated on the order.
6.2. Delivery dates are estimates only.
6.3. Risk transfers on delivery (consumers) or dispatch (business customers). Title transfers once full payment is received.
7. Customised Products
7.1. Customised or personalised items are non-refundable and non-cancellable once production has started, unless defective.
7.2. You are responsible for reviewing and approving all specifications or proofs before we begin production.
7.3. We will not be responsible for errors, misspellings, or design issues that were present in proofs you approved.
8. Consumer Right to Cancel (Distance Selling)
(This applies to UK consumers only for non-customised items ordered online or off-premises.)
8.1. You may cancel your order within 14 days of receiving the goods.
8.2. You must notify us in writing and return items at your cost.
8.3. We will issue refunds within 14 days of receiving goods back (or evidence of return).
8.4. Customised goods are excluded from cancellation unless faulty.
9. Faulty or Damaged Goods
9.1. If goods are faulty, not as described, or not fit for purpose, please notify us within 30 days.
9.2. We will provide a repair, replacement, or refund in line with the Consumer Rights Act 2015.
9.3. Business customers must inspect goods on delivery and report faults within 5 working days.
10. Returns (Business Customers)
10.1. Returns of non-faulty goods are only accepted at our discretion and may incur a restocking charge.
10.2. Customised goods are non-returnable unless faulty.
11. Intellectual Property
11.1. All content, designs, logos, and product imagery created by SEN Creations are the intellectual property of SEN Creations and are protected by UK and international copyright laws. No part may be copied, reproduced, or used commercially without our express written permission.
11.2. SEN Creations may incorporate third-party intellectual property (such as artwork, fonts, patterns, or licensed characters) into products under valid licence agreements. These third-party rights remain the property of their respective owners, and their use is strictly governed by the relevant licensing terms.
11.3. You are not permitted to reproduce, modify, redistribute, or commercially exploit any product or design (including licensed elements) provided by SEN Creations without prior written consent from us and, where applicable, the third-party rights holder.
11.4. By purchasing customised or bespoke products from SEN Creations, you acknowledge that:
You do not acquire any rights to reproduce, distribute, or modify the design beyond personal or internal business use;
You must not remove or obscure any copyright notices or branding included on the product.
11.5. If you submit any content (e.g., logos or text) for use in a custom order, you confirm that:
You own or have permission to use that content;
Its use by SEN Creations will not infringe any third-party rights;
You grant us a non-exclusive licence to use that content for the purposes of fulfilling your order.
11.6. SEN Creations reserves the right to refuse any custom design request that may infringe third-party rights or breach applicable intellectual property laws.
11.7. We may retain images of completed custom products for portfolio or marketing purposes (e.g., on our website or social media). If you do not wish your item to be featured, please notify us in writing when placing your order.
12. Limitation of Liability
12.1. Nothing limits our liability for death or personal injury due to our negligence or fraud.
12.2. We are not liable for indirect, incidental, or consequential loss.
12.3. For business customers, our total liability is limited to the amount paid for the goods.
13. Force Majeure
We are not liable for delays or failures due to events beyond our reasonable control, including supplier failure, transport disruption, strikes, or natural events.
14. Data Protection
We will only use your personal data to process your order, manage your account, and comply with legal obligations. If you opt in (e.g., by ticking a box at checkout), we may also use your information to send marketing communications about our products and services. See our Privacy Policy for full details.
15. Complaints and Disputes
If you are not satisfied with your order, please contact us within 7 days of receipt. We aim to resolve complaints amicably and professionally. Should a dispute arise, both parties agree to attempt to resolve it in good faith before pursuing legal action.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. Disputes shall be resolved in the English courts.
17. Amendments
We may revise these Terms from time to time. The version in effect at the time of your order will apply.
